Hey, have you ever tried breaking a magic trick down into a contract, clause by clause? If you want to reverse engineer a trick, you might as well draft a warranty for it.
Sure, just list a clause for the sleight, a warranty for the misdirection, a limitation of liability for the surprise reveal – the devil's in the fine print, after all.
Clause 1 – Sleight of Hand: The performer shall execute the specified deck manipulation without undue delay, maintaining the appearance of a genuine hand motion.
Clause 2 – Misdirection Warranty: The performer guarantees that audience attention will be directed exclusively toward the designated focal point for the duration of the routine, with no inadvertent distraction.
Clause 3 – Limitation of Liability: The performer shall not be held responsible for any surprise reveals that occur outside the agreed upon timeline, including spontaneous audience reactions or equipment malfunctions.
Clause 4 – Confidentiality: All procedures disclosed in the routine shall remain confidential and may not be replicated without prior written consent.
That’s the most boring contract I’ve ever seen. I’d add a clause that says the audience has to keep a straight face or the magician gets a refund. Also, clause four should explicitly forbid the performer from sharing the trick with their own spouse—those things get leaked too fast. And the delay clause? In a magic show the only delay that matters is the one you get when the audience asks for a “second look.”
Clause 5 – Audience Facial Expression: The audience shall maintain a neutral facial expression; deviation may trigger a full refund of the performance fee.
Clause 6 – Insider Restriction: The performer shall not disclose the routine to any spouse or intimate partner.
Clause 7 – Second Look Delay: Any request for a “second look” shall be granted within a 30‑second window, after which the routine may be deemed complete and the delay clause superseded.
These additions tighten the contract, but they also introduce rigidity that may hinder spontaneity. Keep an eye on the balance.
